Land administration in Bangladesh: Problems and analytical approach to solution

Rapid population growth combined with fast rate of land transfer and land conversion urges for an effective land administration and management in Bangladesh. But the land administration system in Bangladesh is corrupt, inefficient, and unreliable and inherently contains systematic weaknesses. It proliferates and perpetuates the endemic nature of land disputes. Nearly 80 percent of court cases in the rural areas are estimated to be related to land-conflicts.

The region comprises the 15 countries of the former Soviet Union, the former socialist countries of Central and Eastern Europe, and Turkey. Recognizing that the impressive gains from comprehensive land tenure regularization may be short-lived if subsequent transactions are not registered, Rwanda has deployed close to 400 Sector Land Managers (SLMs) throughout the country. Regressions using LAIS data highlight that posting of SLMs increased levels of registered sales but not inheritance transactions and that, for agricultural land, having an SLM taken refresher training almost doubled this effect. A survey of all SLMs in April 2016 suggests that they are fully functional and in close contact with DLOs.

There is a growing recognition that Community Development Agreements (CDA) - if effectively implemented - can promote long-term development benefits for communities affected by mining operations as well as improve relations between extractive companies and communities. Section 139 (1) of Sierra Leone’s Mines and Minerals Act, 2009 provides that small scale or large scale mining licence holders are required to have and implement a CDA with primary host communities if their approved mining operations will or does exceed certain stipulated limits set out in the Act.

This paper presents the empirical findings of a research study undertaken in the Western Province of Zambia. The principal objective was to explore if the issuance of land ownership certificates (LOCs) improves the customary landholders’ perceptions of security of tenure. Thus, we test a null hypothesis that: ‘There are no significant differences in the perceived security of tenure between customary landholders with land ownership certificates and customary landholders without land ownership certificates’.
