Land in the Republic of Tajikistan is exclusive state property, and the state guarantees its efficient use in the interests of the population. One of the main ways of the agricultural development of the country is the improvement of the state of ameliorated land, organization of complete, rational and efficient use of available land and development of new lands.
Chairman of the Government of the Republic of Tajikistan decrees as follows: 1). To validate the proposed Simplified order of land share and its registration. 2). The Committee on land resources and land management attached to the Government of the Republic of Tajikistan and its local branches should determine the size of a land share on the basis of the order approved by the present Decree.
The right of ownership in the Republic of Tajikistan is recognised and protected by law. Enforcement of the right of ownership must not harm the environment and the health of citizens nor must it breach the rights and lawful interests of citizens, enterprises, organizations and the State.
State Committee on Land Survey is a state institution responsible for the state and elaboration of the common state policy in the sphere of land relations and carrying out land reform. State Committee on Land Survey is authorized to carry out its functions directly, through its local branches and land-surveyors of local self-government.
This Regulation establishes principles and procedural rules relative to the transfer of land from its assigned category to another category. The transfer is carried out by district executive committees and the Cabinet in accordance with the Land Code. The Regulations sets out the conditions under which transfer of irrigated land, arable land, plantations, etc.
