An Act to make provision for the orderly and progressive development of land, for the acquisition, preservation and management of historic buildings and sites, for restricting the export of artifacts and for matters connected therewith.

This Act makes provision with respect to planning and control of development in Montserrat and for these purposes establishes the Planning and Development Authority, defines its functions and powers and provides with respect to its organization and administration. The Authority shall prepare a National Physical Development Plan in accordance with this Act. Development on land requires a permission of the Authority. "Development" shall include the use of land for the purposes of intensive agriculture and the subdivision of agricultural land but excludes normal use of land for the purposes of agriculture or forestry. Unless otherwise directed by the Authority, an application for development permission in respect of a development specified in the Third Schedule to this Act shall be accompanied by an environmental impact assessment of the proposed development.
