    The report of the Presidential Commission of Inquiry into the Illegal/Irregular Allocation of Public Land is finally out! Popularly known as the ‘Ndung’u’ Report, the publication of this three-volume document is important to the Kenya Land Alliance for two major reasons. Firstly, the appointment of the Coordinator of the Kenya Land Alliance to the Commission marked a threshold in the relations between KLA and the Government of Kenya.

    This report is the first in a series of research studies that the Economic Commission for Africa (ECA) will produce with a view to improving the understanding of the links between land tenure systems and sustainable development in Africa. In a continent where 80 percent of the population relies on agriculture for their livelihood, the formulation and implementation of appropriate land policies is a paramount factor in poverty reduction strategies. Research is therefore needed to help policymakers take learned decisions when addressing land tenure issues.

    This Proclamation grants the power to specified local public bodies to expropriate rural or urban landholdings for public purpose where it believes that it should be used for a better development project to be carried out by public entities, private investors, cooperative societies or other organs, or where such expropriation has been decided by the appropriate higher regional or federal government organ for the same purpose. The Proclamation sets out the procedure of expropriation and provides with respect to compensation (which shall be paid in advance) and appeals.

    The aim of this paper is to explain in what ways work representation may contribute
    to an efficient governance structure. The insights from institutional economic theories
    will be applied to two different kinds of employee participation, namely trade unions
    and works councils. From the discussion it follows, that the latter may be better
    equipped than the former to play an effective role in corporate decision-making,
    owing to its specific institutionalisation. The paper concludes with the finding that
