Across many parts of Indonesia, investment in oil palm has brought accelerated forms of land acquisition and market engagement for communities, signalling far-reaching implications for equity and well-being of current and future generations. Alternative land use remains a controversial issue in Indonesia, particularly with regard to regions outside Java. This paper aims to highlight forest land use dynamics in Indonesia, and particularly the difficulties of resolving the conflicts between conservation, the need to preserve local livelihoods, the demands of the logging industry, both legal and illegal, and the pressures to convert land from forest use to other uses, mainly agriculture, plantations and mining.

Land grabs in the wake of a disaster are nothing new. However this phenomenon gains certain particularities and interest when it happens within the current context of climate change policy initiatives and the global land rush. This nexus produces a new set of political processes containing new actors and alliances, legitimizations, and mechanisms of dispossession that set off a different pace for land grabs. This study explores this nexus which has the potential to swiftly reboot spatial, institutional and political land arrangements in poor communities on a large scale, globally.

After the Doi Moi (‘renovation’) reforms in Vietnam from 1986, land ownership rules were adjusted, effectively terminating former land collectivisation efforts. While land ownership remained fully under the control of the state, a 1993 land law conferred 20-year leaseholds to most farmers. They could now utilize farm land individually, and sell, swap and mortgage the land in a situation similar to private ownership. These leaseholds are now expiring and a new 2013 land law is in the making.

This guidebook provides conceptual, legal and practical tools and resources to help civil society organizations guide communities through the process of documenting customary tenure at the local level. It also provides suggestions for how to build on the momentum generated by the documentation process to develop strategies and actions to defend, strengthen and promote customary rights at community, regional and national level. The guidebook was developed out of practical experience and conversations with local groups in Myanmar that have been documenting customary tenure.

Oil palm plantations in Indonesia have been linked to substantial deforestation in the 1990s and 2000s, though recent studies suggest that new plantations are increasingly developed on non-forest land. Without nationwide data to establish recent baseline trends, the impact of commitments to eliminate deforestation from palm oil supply chains could therefore be overestimated. We examine the area and proportion of plantations replacing forests across Sumatra, Kalimantan, and Papua up to 2015, and map biophysically suitable areas for future deforestation-free expansion.
