    After more than ten years of hectic debates on international ‘land grabs’, academic interest in collapsed land deals or projects with unexpected results is growing. According to the Land Matrix, Tanzania is one of the target countries for such deals, with a number ‘abandoned’ or delayed and projects whose status is unknown. Labelling land deals as ‘failed’ poses conceptual and methodological challenges as long as the criteria for ‘failure’ are undefined.

    Les autorités maliennes ont mis en place des commissions foncières (CoFo) en vue de prévenir et de résoudre les conflits fonciers. Ces commissions sont confrontées à des problèmes de fonctionnement liés au manque de ressources financières. De fait, de nombreuses CoFo ne sont pas opérationnelles ; seules quelques-unes fonctionnent en mode projet grâce au soutien financier des partenaires techniques et financiers au développement.

    This article discusses the inherent limitations of law in transitional justice processes regarding land grievances. Through analysis of the case of Timor-Leste (East Timor), a country marked by post-colonialism, post-authoritarianism, and post-conflict. The article shows how complex transitional justice regarding land grievances can be, and argues that a legalist perspective gives a limited view of these grievances, both for studying and finding solutions to them. The article employs the concept of ‘wicked problems’ to overcome the limitations of law.

Through six case studies — Ukraine, Zambia, Myanmar, Papua New Guinea, Sri Lanka, and Brazil — the report details the myriad ways by which governments — willingly or under the pressure of financial institutions and Western donor agencies — are putting more land into so-called “productive use” in the name of development.

    This paper is one of three thematic case studies resulting from a set of pilot projects undertaken jointly by civil society and private business partners from 2016–2019 in five countries in sub-Saharan Africa. These pilots sought to test how private companies could collaborate with civil society organisations and other stakeholders to implement responsible agribusiness investments that recognise and respect community land rights, and to develop innovative tools and approaches that could be adopted and implemented at greater scale.

    The rise of land deals poses unpredictable risks to war-torn societies, exposing them to the violent folds of the global economy. In Sierra Leone, commercial land leases have perpetuated the chieftaincy monopoly, further curtailed social mobility, and sparked particular resentment among youths and ex-combatants. Drawing on the concept of the “war machine,” I analyse how Kamajor militia fighters shape contestation against land deals and explore the attendant risks for remobilisation and conflict transformation.

    Tenure risk – or the risk of dispute between investors and local people over land or natural resource claims – is endemic in emerging markets. There are hundreds of recorded incidents of tenure disputes creating delays, violence, project cancellation and even bankruptcy at a corporate level. These tenure disputes create lose-lose outcomes for investors, local people and national governments while robbing emerging markets of the developmental benefits of responsible land investments.
