    This article discusses the implication of the 2021 CASAC v Ingonyama Trust judgment on South Africa’s land governance policy trajectories. It explores the extent to which there are missing links between policy imperatives, the legal system, court processes and socio-economic emancipation. It argues that the failure of the state in policy design and implementation has turned courts into contradictory sites of struggle for emancipating land rights.

    Le Togo est un des plus petits pays objet de l’étude : sa superficie n’est que de 56 785 km², grossièrement répartis en deux systèmes de plaines, un au Nord et un au Sud, séparés par un ensemble de plateaux centraux, dont le massif de l’Atakora. Par contre, la population est relativement importante avec près de 6 millions d’habitants (avec un taux de croissance annuel de 2,7 % pour la période 2000-2006)1, dont près de 40 % dans les agglomérations de plus de 5 000 habitants. Selon une formule de R. Cornevin, le Togo représente « toute l’Afrique en 600 kilomètres »2.

    L’homme à travers ses actions dénature fortement l’occupation des sols engendrant une modification du milieu naturel. Cet impact rend la nécessité de fournir aux décideurs des cartes d’occupations des sols et des informations relatives à leur état et dynamique. C’est dans cette optique qu’une étude de l’occupation des sols a été conduite dans les carrières de phosphates au sud-est du Togo. Cette recherche vise à analyser la dynamique spatiale de l’occupation du sol dans ces carrières.

    Land registration and property rights in Iraq have deep historical foundations reaching back to the Hammurabic period. However, the current land registration system owes more to the 400-year Ottoman occupation of Iraq and the subsequent interval under the British mandate. Under these regimes, land policy was self-serving and designed to maintain and reinforce the existing political power. This was done through the allocation of land to influential individuals who supported the incumbent regime.
