Because of changes in some underlying factors, land is increasingly becoming a source of conflicts in Africa. We estimate the determinants of land conflicts and their impacts on input application in Kenya by using a recent survey of 899 rural households. We find that widows are about 13 percent more likely to experience pending land conflicts when their parcels are registered under the names of their deceased husbands than when titles are registered under their names.

Indigenous, mobile, and local communities all over the world have for millennia played a critical role in conserving the earth’s patrimony. They have protected forests, wetlands, rangelands, watersheds, hunting grounds, rivers and streams and other water catchment systems that are to day the basis of prosperity for all nations. “Community” husbandry of these resources has been done for a wide range of reasons ranging from economic, cultural, spiritual, aesthetic to many others.

Questioning the mythologies of Hernando de Soto
Documents de politique et mémoiresoctobre, 2005Global, Afrique, Afrique du SudDe Soto’s influential book The mystery of capital offers a simple yet beguiling message: capitalism can be made to work for the poor, through formalising their property rights in houses, land and small businesses. This approach resonates strongly in the South African context, where private property works well for those who inhabit the so-called ‘first economy’. Evidence from South Africa, however, suggests that many of de Soto’s policy prescriptions may be inappropriate for the poorest and most vulnerable in our society, and have negative impacts on their security and well-being.

“Land registration and cadastral surveying in much of the developing world has reached a crossroads. It is not possible to continue with business as usual in the face of massive informality within the world's cities, and new more relevant approaches have to be developed”. (Fourie, 2000).

Federal and state governments are searching for programs and/or policies to deal with the risks linked with uncertainty in water supplies and demands. Within the United States, competition among agricultural, urban, and environmental concerns for water is increasing. Drought conditions and water use restrictions have, at times, limited water supplies for these varied uses. The federal government stands in a unique position as both a major supplier and demander of water. As such, the federal government has put forward several programs for water conservation, information, and usage.

This paper explores the puzzle of why the pastoral Maasai of Kajiado, Kenya, supported theindividualization of their collectively held group ranches, an outcome that is inconsistent withtheoretical expectation. Findings suggest that individuals and groups will seek to alter propertyrights in their anticipation of net gains from a new assignment, even as they seek to eliminatedisadvantages that were present in the status quo property rights structure.

While there has been considerable discussion of the institutional mechanismsfor PES, relatively little attention has been given to the inter-relationships between PESinstitutions and other rural institutions.

In an opening vignette to an otherwise insightful article, Carol M. Rose (2003) comparespeople who hold intellectual property rights to poor villagers in India. They put effort and timeinto developing small but productive properties, only to have the wild tiger or rogue elephant ofthe public domain trample them or eat them up. In extreme cases, IP "villages" are abandonedand left to "the jungle" of public property.
