    In recent years, the call of civil society organizations to formalize rights of local communities and Indigenous Peoples to forests has been growing louder. They argue that formalizing local forest rights will have positive outcomes for livelihoods as well as forest conservation. In response to these calls, many governments have started forest reforms. This has become known as the forest tenure transition.

    Social forestry programs, aimed to reduce poverty in forest communities while maintaining the forest function, are increasingly incorporating gender issues and responsiveness. By design, social forestry program is supposed to promote justice and equality for forest users, but on the ground discriminatory practices against women are occurring. Drawing case study from two Indonesian villages, this study examined the extent of discrimination against women in the implementation of the state social forestry programs.

    Over the past two decades, growing recognition of forest-based Indigenous peoples and local communities (IPs and LCs) sparked forest tenure reforms to formalize IP and LC rights to forests and forest lands through a variety of mechanisms. Nevertheless, tenure security, an intended objective of such reforms, has received less attention, despite being integral to the life and livelihoods of IPs and LCs and important for forests.

    This report brings together four studies that evaluate regulatory initiatives with implications for forest-dependent communities from a rights-based perspective. These are: The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 – India; Regulatory initiatives and selected outcomes of judicial processes in Malaysia; The Community Forest Act (2007) – Thailand; and The Indigenous People’s Rights Act (1997) – Philippines. Each study covers law making, content and implementation.

    The laws in the Republic of Congo and the Central African Republic provide limited protection to indigenous peoples and local communities regarding access to land and forest resources. Often, logging concessions overlap their territories, restricting access to lands and resources. However, the development of community forests is gaining momentum in the region. These can help secure customary tenure, sustainably manage resources and improve livelihoods for indigenous peoples and local communities (IPLCs).
