In a context of conflict affecting northern Cabo Delgado, the government approved the request for allocation of 12,000 hectares of land located in Palma in favour of the Cabo Delgado Economic Development Promotion Centre (CPD), an unknown public entity created in May 2021 and whose attributions and competences are confused with the mandate of the Integrated Development Agency of the North (ADIN). The approval of the provisional DUAT in favour of the CPD was not preceded by a public consultation with affected communities, as required by land legislation.

The Sustainable Development Goal 15 “Life on land” commits world leaders to work together to achieve land degradation neutrality (LDN) for safeguarding life on land. One of the objectives that comprise LDN is to reinforce responsible governance of land tenure. Land rights are a key factor for achieving LDN. This publication by the UNCCD CSO Panel aims to analyze and highlight the linkages between land rights and land degradation with the objective of offering policy recommendations to enhance land rights for both the prevention of land degradation and the recovery of degraded lands.

This policy brief presents strengths and weaknesses of state and traditional land justice institutions in relation to access, costs and speed in concluding the process of resolving land cases. In the current legal and institutional framework, strengthening of the customary justice system would bring benefits. With 93% of land in the Northern and Eastern regions under customary tenure, the most important institution is the clan, yet clan rulings are most often ignored by a parallel state system.

Public lands accounted for 80% of the country area until a decade ago. As Cambodia emerged from three decades of civil war and internal strife, the Royal Government of Cambodia (RGC) has granted more than 10% of the country area or 50% of the cultivatable land as large scale “Economic Land Concessions” (ELCs) to private companies, mostly foreign owned, in a mostly rigged process. Land disputes have become a permanent fixture in the press and a hot issue on human rights reports.

The validity of a title deed, or whether a property owner purchased in good faith, has recently been questioned and rejected by the land commission, a body under the auspices of the office of the presidency. In 2015 for over two weeks, both residents ‘abasangwa’ and repatriates ‘abahungutse’, stood together to oppose the Burundi land commission: the Commission Nationale Terres et autres Biens (CNTB, National Commission of land and other Assets), who are revisiting land restitution cases it had previously settled.

Corruption is the abuse of entrusted power to acquire illicit benefit for private gain. Corrupt practices in the context of land administration and land management have come to be known as ‘land corruption’. As with all other forms of corruption, it thrives in the dark corners of closed systems where transparency is lacking, and accountability can be avoided.

In 2015, 193 countries affirmed their commitment to the 17 goals of the 2030 Agenda for Sustainable Development, including Germany. According to an estimate by the United Nations in 2018, the international community loses 5% of global gross domestic product through corruption. Effective measures to combat corruption are therefore a prerequisite for achieving the ambitious goals of the 2030 Agenda.

Many information technology initiatives have emerged in recent years with the aim of improving natural resource management. These take a variety of technological forms designed either to directly curb corruption in resource extraction and production, or to enhance information flows, facilitate citizen participation, and hold specific actors accountable. Donors can play a role in connecting the divide between development practitioners, technologists, and researchers by supporting the use of tools in programs and evaluations.

This paper analyses patterns of corruption and corruption risks related to community mineral beneficiation schemes (CMBSs) that distribute benefits funded by mineral revenues to communities. It analyses insights from existing scholarship on CMBSs, evidence from seven cases of corruption, and lessons from guidance documents on reducing corruption in the mining value chain. The aim of the paper is to stimulate debate and further research about the suitability of anti-corruption strategies for CMBSs.
