According to the provisions of this Ordinance, where any land belonging to a temple is acquired for public purposes under the Land Acquisition Act, all sums of money awarded as compensation for or in respect of the acquisition of that land shall be paid to the Public Trustee.

The Governor of Orissa in exercise of the powers conferred under sub-paragraph (2) of paragraph 5 of the Fifth Schedule of the Constitution of India has promulgated this regulation to Control and Check Transfers of Immovable Property in the Scheduled Areas of the State of Odisha by Scheduled Tribes (ST). Any transfer of immovable property by a member of a ST to non-STs, except by way of mortgage in any public financial institution for securing a loan granted by such institution for any agricultural purpose, shall be absolutely null and void.

These Regulations establish the basis for assessing the market value of any land or the compensation for any injurious affection caused by the acquisition of land. Market Value should be assessed as follows: in case part of a land is acquired and when its value as a separate entity deems to realize a value proportionately lower than the Market Value of the main land the compensation should be proportionate to the value of the main land.
