    The VGGT Popular Version for Communal Land Administration was developed to support the Parliament of Namibia in delivering training to traditional authorities and regional institutions to enhance their capacity to administer communal land within their jurisdictions. This was carried out in line with the Communal Land Reform Act, Act 5 of 2002 and the resolutions of the 2nd National Land Conference. The Popular Version outlines 14 pertinent land governance issues in Namibia’s communal areas.

    This case study draws on research that investigated the financial sustainability of cities in the Southern African region. The research was undertaken by the South African Cities Network (SACN). The project was jointly sponsored by the Public Private Infrastructure Advisory Facility and the World Bank. The contribution by SACN of the material for this document is gratefully acknowledged. The learning material presents an outline of the many challenges of financial sustainability and effective service delivery facing Southern African cities.

    The Food and Agriculture Organization of the United Nations (FAO) has developed a series of Technical Guides to elaborate and provide more detailed guidance on thematic areas contained within the Guidelines. As part of this series, this Technical Guide covers the issues associated with the identification and valuation of tenure rights for different purposes, and provides guidance on how to ensure that valuations are undertaken in a fair, reliable and transparent manner that comply with internati onal norms.

    This Act converts the National Special Risks Insurance Association established in terms section 21 of the Companies Act, 2004 into a public company having a share capital, with shares held by the State. It also determines the nature and ambit of the special risks that the Company may underwrite and the role of the State in the short-term insurance industry as regards special risks and to reduce the reinsurance risk exposure of the State. One of the risks that may be covered is loss in respect of a mortgage loan. Risks may arise from political strife or public disorder.

    The cities in southern Africa reflect the rapid urbanisation characteristic of sub-Saharan Africa in general. Angola, Botswana and South Africa have the highest levels of urbanisation with about 60% of their population living in cities in 2010 and this percentage is expected to rise to about 80% by 2050.

    Members of rural communities in Namibia often lack a basic understanding of what their user rights and responsibilities are under the Communal Land Reform Act and are also unaware of their rights to object to a proposed land allocation or to appeal a decision once made. The large-scale acquisition of land for agriculture and conservation projects often displace local communities or reduce their access to control and ownership of key resources due to the gaps between good legislation and inadequate implementation and enforcement.

    Describes a long-standing grazing dispute in northern Namibia that provides critical lessons on the challenges that people living in communal areas face to secure their land rights. Several large livestock owners illegally enclosed community rangelands to secure grazing for their own commercial cattle herds. The communities used legislation to defend their land rights: they mobilised relevant government and traditional authorities to intervene, resulting in a court order for the removal of most of the illegal cattle owners.

    Across Africa, Asia and Latin America, investors are increasingly approaching rural communities seeking land for logging, mining, and agribusiness ventures. Even in those situations where the investors have followed FPIC guidelines and undertaken a formal “consultation” with the community, these consultations are generally conducted in a context of significant power and information asymmetries. Part of the power imbalance comes from communities’ lack of information about the value of community lands and natural resources.
