    The paper examines the pace of land acquisitions in terms of creating legislative and policy options to safeguard local communities that are directly affected, including compensation for land that is taken, and protecting community interests in the socio-economic and environmental continuum of investment projects, from design to implementation. The absence or weakness of formal landholding and land registration systems was evident in most research sites in Isiolo and Lamu.

    This Act provides rules for the prospecting for and mining of minerals specified in the First Schedule to this Act. Save to the extent provided for in this Act, it shall not apply to matters relating to petroleum and hydrocarbon gases. The Cabinet Secretary responsible for mining, the Principal Secretary of the responsible ministry and any person shall be guided by the values and principles enshrined in the Constitution and in particular Articles 10, 66 (2), 201 (c) and (d), and 232 of the Constitution and the principles of leadership and integrity.

The advent of settlers and colonialism in East Africa placed land in a high level of importance than before. It is not a unique situation for Kenya. Wars have been fought world over with ownership of land and other resources associated with it being at the center of controversy. When colonialism set in, many people were displaced from their original homes.

    Land has been and remains a politically sensitive and culturally complex issue for Kenya. Kenya’s history with regard to the land question is characterized by indications of a breakdown in land administration, disparities in land ownership, tenure insecurity and conflict. It was therefore against this backdrop that land reform was identified as an essential component of Kenya’s National Dialogue and Reconciliation (KNDR) process and in particular, agenda item 4 on addressing long standing issues.

    The Commission has been in the forefront of promoting good governance and accountability in the land sector. Progress in the land sector has been mixed. Through the effort of the government, support agencies and other stakeholders the Commission was able to devolve its function to the 47 counties through the County Land Management Boards (CLMBs). The CLMBs have in effect devolved land services throughout Kenya. However, achieving land, better land governance, accountability in the land sector and ensuring secure land rights for all Kenyan is still to be achieved.

    The absence of a clearly defined land use policy in Kenya after years of independence has resulted in a haphazard approach to managing the different land use practices and policy responses. Land use continues to be addressed through many uncoordinated legal and policy frameworks that have done little to unravel the many issues that affect land use management. The Constitution of Kenya 2010, Kenya Vision 2030 and the Sessional Paper No. 3 of 2009 on National Land Policy all call for a clear framework for effectively addressing the challenges related to land use.

The question of environmental migration is inevitably linked to the question of land for several reasons. First, climate and environmental change trigger and accelerate the loss of land due to sea-level rise, coastal erosion, landslides and other forms of land degradation.
