This guide seeks to highlight the steps that concerned parties and communities can take to address the challenges that mining poses on communities. It gives communities the tools they need to understand the law that governs mining and to protect their rights. Although it focuses on South Africa, the tools proposed will be relevant for communities facing similar issues in other countries.

Contemporary discourses on customary land tenure in Africa, and South Africa in particular, have emphasized the socially embedded and flexible nature of customary land rights, recognising these as inherently more ‘pro-poor’ than individual titling. Based on in-depth interviews and participant observations in Venda, a former homeland in South Africa, this paper explores how in the context of expanding commodity frontiers, customary land markets have emerged, leading to de facto privatisation of customary land.

Land Portal and the Council for Scientific and Industrial Research (CSIR) have collaborated on this project designed “…to uncover, democratize and improve the land data and information ecosystem in South Africa” (Land Portal Foundation, 2019). This is one of a number of State of Land Information (SoLI) projects in an international process covering a number of countries. The first part of the project involved in-country teams scoping the information landscape (resulting in this report).

The Voluntary Guidelines on the Responsible Governance of Tenure (VGGT) call for governments to clearly define the term ‘public purpose’ to allow for judicial review of the goals of expropriations of property. However, recent research indicates that national-level legal frameworks that govern expropriation decision-making not only vary greatly from country to country but also often fail to comply with the VGGT standards on expropriation. This creates the potential for unpredictable and, in some cases, arbitrary applications of expropriation law in practice.

A community’s choice to give, or withhold, their free, prior and informed consent (FPIC) to a project or activity planned to take place on their land is a recognized right of Indigenous peoples under international law. It is also a best practice principle that applies to all communities affected by projects or activities on the land, water and forests that they rely on.

Urban land markets have a profound effect on how well poor households are able to access the jobs, amenities and services offered in the city. But often the way in which this market works frustrates attempts to open up better located living and business opportunities for poorer urban households and communities, despite government policies and programmes intended to address these challenges. The challenge in South Africa is even larger because of worsening poverty and inequality, and the continuing growth of cities through urbanisation.

This case study draws on research that investigated the financial sustainability of cities in the Southern African region. The research was undertaken by the South African Cities Network (SACN). Mutual suspicion has characterised the relationship between the South African government and mining companies, particularly in recent years. Resolving the current impasse would require a panoply of policy interventions because of the complexity and age of the mining industry. This briefing proposes that one such intervention could be the introduction of a structured workplace secondment programme between the Department of Mineral Resources (DMR) and mining companies – together identifying critical areas for co-operation and skills transfer.
