This brief explores the reform of land tenure institutions which re-emerged in the 1990s, and asks if these reforms are any more gender sensitive than those of the past? The paper highlights that a focus of the recent reforms has been on land titling, designed to promote security of tenure and stimulate land markets. The reforms have often been driven by domestic and external neoliberal coalitions, with funding from global and regional organisations which have argued that private property rights are essential for a dynamic agricultural sector.

This paper examines how developing countries have attempted to promote rural development through biofuel production, what social outcomes those strategies have created and what lessons can be learned. This is done by comparing the contexts of Brazil, India and Indonesia; three countries with important agricultural sectors that have put large-scale biofuel programmes in place. The analysis indicates a disparity between the social discourse and the adopted biofuel policy instruments.

Today, many rural poor Filipinos are using state law to try to claim land rights. In spite of the availability of a much stronger set of legal resources than ever before, claiming legal land rights remains difficult. Some argue these difficulties are a reason to turn away from state-led land reform and toward a market-assisted land reform (MALR) model.

This compendium provides an improved understanding of the complex issues concerning gender and land. It draws on research commissioned by FAO. The authors argue that hunger and poverty are, in general, consequences of inadequate and restricted access to land and other resources, such as capital, inputs and technology; women are among those with less access to land, while accounting for a large share in small-scale food production.Rights to land, especially women’s rights to land, are determined by a complex interaction between the institutions, and underlying power relations, of a society.

It uses official statistics, literature and case study material to identify the scope for emission reductions, in terms of potential additionality, opportunity costs, technological complexity, transaction costs, and risks of economic and environmental spill-over effects.

    Brésil, Amérique latine et Caraïbes

This working paper focuses on the Movement of the Landless (MST) and the various legal strategies used to redefine property law in Brazil. Through a number of legal strategies MST has helped produce watershed high court rulings, contributed to the process of constitutionalising law, and made access to land more equitable in parts of Brazil by redefining property rights in practice. The paper explores legal change triggered by the strategic action through what Bourdieu calls the juridical field (relating to the function and administration of the judicial system).

    Brésil

This paper examines the paradoxes of land governance in Brazil by putting them in their historical context, highlighting in particular the continuing subordination of peasant farmers’ interests to those of large landholders. It traces the development of the country’s regional divisions and systems of land-holding back to colonial times, when Portuguese settlers began carving up the territory.
