    In Uganda’s Kabale district, too many people had been trying to make a living from too little land. Because of overpopulation and exhaustion of the soil by intense cultivation, the area had gone into decline. Then, researchers and farmers — supported by the International Development Research Centre — joined forces to revitalize the region.

    A detailed situation analysis reveals key linkages between meagre services, insecure land tenure, and unjust governance institutions in Nairobi’s informal settlements. In addition to exploring alternative models of service delivery, the analysis examines the “poverty penalty” and the types of service provision specific to Mukuru settlement, where residents are forced to pay for poorer services. Private holdings in Mukuru should be converted to community land, using provisions from the Constitution, Land Act, and the draft community land bill.

    The animosity created during land contestations makes it impossible for widows, wives and mothers to peacefully settle land claims and use their land. The research evidence provides a platform to advocate for a transformative agenda to improve rural poor women’s access to and control over land and other natural resources. This includes building linkages with the wider advocacy relationships and programmes of International Land Coalition (ILC - www.landcoalition.org).

    Land distribution is highly skewed in Africa, where women’s ownership of land is a small percentage of that owned by men. Women frequently lack the resources to acquire land in their own right and are further disadvantaged by discriminatory inheritance laws, customary practices and market structures. This report summarizes presentations at the symposium on women’s rights and access to land.

    This policy brief is divided into three parts: research findings, policy analysis, and recommendations. Daily political and social processes determine what Kenya and Kenyans are becoming. The place where this becoming started was with colonial conquest and the resistance to conquest. The government needs to build institutions that nurture the direct participation in governance of the country by grass roots Kenyans, as well as by addressing the land question in order to reduce biases that reify ethnic identities and violence.

    This research reviews legislation and policies in Zimbabwe that have a direct or indirect bearing on the relocation of communities. The current model for large-scale investments has changed from previous models, where the majority of investment projects were undertaken by international companies with limited governmental intervention. While relocation of communities may be inevitable, it is argued that such actions should take into account constitutional provisions, regional and international best practices.

    The research aims to develop a legal and policy framework that will facilitate integration of environmental protection with socio-economic activities during land use decision-making, as a mechanism to achieve sustainability. A statutory duty of care, with respect to land use, would make it clear that land owners or occupiers have definite responsibilities to protect and enhance the sustainability of the land that they use or manage; it would aim to reverse existing land degradation, or include a duty to inform other land owners or the state about some kinds of foreseeable degradation.
