It is not possible to secure tenure at Ekuthuleni, for the purposes for which people want that security, within the current legal, technical and institutional frameworks. A small window of opportunity still exists that might allow us to reverse this judgement.

Thai factory owners face huge claims after judge rules for Burmese migrants.
About 200 Thai factories employing migrant Burmese workers are braced to meet compensation claims amounting to many millions of dollars following the success of a legal action brought by 18 employees in Thailand’s Tak Province.
The Burmese migrants were awarded a total of 1,170,000 baht (US $29,250) in compensation for unpaid back wages owed by their employer, the Nut Knitting Ltd Partnership in Mae Sot, on the Thai-Burmese border.

The analysis shows that clear empirical evidence exists, demonstrating that community forestry has provided tangible benefits to poor people. However, the evidence is limited to a few cases and there is no clear indication that these benefits have been scaled-up across a wider range. This has been a general pattern across the whole development sector, not just within forestry.
