   The limited research on the benefits of women gaining secure rights to land and property suggest positive results: an increase in women’s participation in household decision-making; an increase in net household income; a reduction in domestic violence; an increased ability to prevent being infected by HIV/AIDS; and increased expenditures on food and education for children. Understanding the complexity surrounding women’s land rights is critical to ensuring that those rights are protected and improved.

   Last week, the United States hosted the 2012 Intercessional meetings of the Kimberley Process Certification Scheme (KPCS). The KPCS is a voluntary process that diamond producing and diamond buying countries agree to, in order to prevent ‘conflict diamonds’ from entering the market. Ambassador Milovanovic and the State Department serve as the chair for activities this year; however, USAID is playing a role due to the increasing emphasis on development as a critical component to successful implementation of the KPCS.

   A recent USAID publication titled, The Global State of Agriculture, cites access to land as one reason why women farmers are less productive than men.    Writing at the Council on Foreign Relations’ “Africa in Transition” blog, John Campbell notes that South Africa’s land “issue” is not so simple. How true. Back in 1994 the ANC pledged to transfer ownership and control of 30% of white-owned farmlands to black South Africans by 2014. The process, based on a “willing buyer/willing seller” model has been halting at best and too often communities and farmers that did benefit from a redistribution of land lacked the background or capital to develop sustainable commercial entities.

   Although many African countries have recently adopted highly innovative and pro-poor land laws, lack of implementation thwarts their potentially far-reaching impact on productivity, poverty reduction, and governance. We use a representative household survey from Ethiopia where, over a short period, certificates to more than 20 million plots were issued to describe the certification process, explore its incidence and preliminary impact, and quantify the costs.

   Significant progress has been made over the past decade or so in the development of policy and legislation that support the recognition of customary rights to land, with important legal rulings in Tanzania, Uganda, Mozambique, South Sudan, and South Africa. At the same time, the strengthening of communities’ traditional rights to use resources has progressed through community forest reserves and community conservation areas.

Women's land rights are the point of intersection between empowerment and nutrition.
