    There shall be a Director of Land Surveys who shall: (a) direct and control all public surveys; (b) supervise and control all other surveys; (c) examine all general and particular plans of surveys made in respect of leases of land; (c) approve such plans if satisfied that such surveys have been carried out and the plans prepared in accordance with the provisions of this Act; and (d) carry out other functions outlined in section 2.

    This Chapter concerns use and lease of public land. The Public Lands Trust Board of Trustees may, subject to provisions of this Chapter, authorize use and lease agreements in respect of public lands. Land may be leased to foreign companies but only for the time they are doing business in Pohnpei. Rights to minerals and exhaustible resources and other uses defined by the Board to be of public interest. The Chapter also places restrictions on subleases of residential leases issued by the Pohnpei Public Lands Trust Board of Trustees.

    This Chapter establishes procedures to be followed by the Pohnpei Government in the exercise of its inherent power to acquire real property by eminent domain. “Eminent domain” is the right of the Pohnpei Government or a state legal entity as may be provided for by state law in accordance with this Chapter to condemn property for public use or purposes and to appropriate the ownership and possession of such property for such public use upon paying the owner a just compensation to be ascertained according to the law.

    This Chapter sets out conditions and procedures for non-judicial foreclosing on the property of a debtor by the creditor. The Chapter sets out when and how a creditor may take possession of the property with or without notice, but only if this can be done without breach of the peace.     This Act concerns the distribution of land held in the public trust. The purpose of this Act is to distribute lands held in trust for the people of Pohnpei to beneficiaries of the trust who have entered upon, developed, and possessed such lands for agricultural purposes pursuant to leasehold or other use agreements issued for that purpose by the government of Japan or the Trust Territory Government. The Act sets out criteria and procedures for transfer of title in land.

    This Chapter establishes rules for the fair and equitable treatment of persons displaced by the acquisition of real property by the Pohnpei Government and local land acquisition programs or by programmes that require relocation. If an agency acquires real property for public use, it shall make fair and reasonable relocation payments to displaced persons and businesses in accordance with this Chapter. An Agency shall also set up a relocation assistance advisory programme.

    This Chapter sets out conditions and procedures for judicial foreclosing on the property of a debtor by the creditor. The creditor may bring a civil action for foreclosure in such manner as the court may order. The creditor may at any time abandon non-judicial foreclosure procedures and proceed by a civil action. After having carried out the proper procedural requirements regarding the defendant or defendants, the court may order foreclosure in such manner as it deems will best protect the rights of the parties.
