    This brief considers the current state and practice of dispute resolution mechanisms in Cambodia, which have been formed to address land disputes and conflicts. The first section introduces land rights abuses in the context of economic land concessions and land grabs, and discusses the relevance for studying land dispute resolution mechanisms in Cambodia. The second section describes the five main dispute resolution mechanisms and the jurisdiction of each mechanism depending on the type of land dispute involved.

Since 2007, the Royal Government of Cambodia has implemented the “Land Allocation for Social and Economic Development” (LASED) program with technical support from GIZ and financial support from the World Bank.     The purpose of this assessment is to assist identification of key drivers of deforestation and/or forest degradation in Cambodia and review past efforts to reduce deforestation and forest degradation, in order to identify promising approaches for the national REDD Strategy. The report focuses on drivers of deforestation and degradation and additional components covered under REDD+, i.e. conservation, sustainable forest management and enhancement of carbon stocks, other than in the extent to which these aspects contribute to reducing deforestation and forest degradation.

    Land is the most important productive asset in agrarian societies such as Cambodia’s. Throughout Cambodian history, land ownership rights have varied with changes in government. In the period before French colonisation (pre-1863), when all land belonged to the sovereign, people were freely allowed to till unoccupied land and could cultivate as much as they liked. With French colonisation, a property-rights system was introduced in 1884.

    All four countries in continental South-East Asia featured in this paper (Myanmar, Cambodia, Laos and Vietnam) are experiencing land conflicts that could potentially destabilise their governments.1 Thailand is in a similar situation in many respects, as it has faced mounting tensions over land tenure since the 1990s (Hall et al., 2011). These conflicts are escalating, sometimes violent, and are attracting more and more attention from the media. They have mobilized numerous local and international NGOs, and often triggered the development of an increasingly visible national civil society.

    Thirty years after Cambodia’s ‘democratization’ by the United Nations Transitional Authority (UNTAC), the transition to a market-based economy is raging at full steam. Democracy remains elusive, but policy interventions from Cambodia’s “development partners” color the political, social, and environmental landscapes. This paper attends to the land grabs characteristic of market transitions and to the climate change mitigation strategies currently enhancing conflicts over land and resources in contemporary Cambodia.
