    Land in Uganda is a delicate resource that has caused many conflicts over the past years. About 80% of pending court cases in the country relate to land today. Looking at the country’s violent history, a rising population and increasing impact of climate change on agriculture productivity, land rights in Uganda are contested to this day. Land conflicts are either within communities, family structures or between individuals and external players such as investors.

    Displacement induced by large scale investments and subsequent resettlement affects community access to land, land tenure patterns, and tenure security. This guide is published as part of the project ‘Strengthening Community Land Rights and Responses to Involuntary Displacements Caused by Development Projects in Zimbabwe.’ It highlights critical areas to be accounted for before introducing large scale developmental projects. These projects endanger communities’ land-related environmental, economic, social and cultural rights and benefits enshrined by the Constitution of Zimbabwe.

    The Rights-based Approach (RBA) allows local communities, or others who are marginalized, excluded or discriminated (the rights holders), to exercise their rights; and for institutions, organizations or other agencies (the duty bearers) to provide support towards equitable and inclusive development programmes that benefit them. RBA interventions can address inequities and disparities evident in these communities. In the context of the management of forested landscapes, RBA emphasizes the rights of local communities for fair benefits, access to resources, secure tenure and gender equity.

    The principle that indigenous peoples and local communities have a right to give or withhold their Free, Prior, and Informed Consent (FPIC) to developments affecting natural resources is not new. However, experience using FPIC in REDD+ implementation is still limited in the Asia-Pacific region, and there are few materials that explain and train practitioners in its concepts and practice. There is still subjective understanding of the terms and requirements of FPIC, influenced by both cultural interpretations and interests.

    This guide seeks to promote the use of ADR mechanisms to settle land rights disputes involving occupiers, labour tenants, landowners, claimants and other key role-players.     This is a brief description of a course organized by the Regional Government of San Martín in Peru and ProTierras Comunales and implemented in coordination with the regional and local indigenous organisations in 2018.  ProTierras Comunales is part of the Global Project “Responsible Land Policy”, implemented since late 2015 by German development cooperation in six countries in Africa, Asia and Latin America to promote the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests (VGGT, 2012).
