    “Customary land”, “private land” and “public land” shall bear the same meaning in this Act as in the Land Act. The Minister may apply the provisions of this Act to areas in which, according to the Minister, ascertainment of interests in customary land or the agricultural development of such land require the application of provisions of this Act.

    The Act makes provision for various matters relating to customary land, private land and public land and powers of the Minister in respect of such land.The Act consists of 44 sections divided into 8 Parts: Preliminary (I); general (II); Private Land (III); Private land (IV); Customary land (V); User of land (VI); Trespass or encroachment upon, or unlawful occupation of, land (VII); Miscellaneous (VIII).A Corporation may hold land only with a license from the Minister (sect. 3). The Minister may dispose of public and customary land in accordance with section 5.

    The Contracting States, in the belief that objectives set out in the Preamble would be better achieved by amending the 1968 Algiers Convention on the Conservation of Nature and Natural Resources by expanding elements related to sustainable development, have agreed on measures to enhance environmental protection, to foster the conservation and sustainable use of natural resources; and to harmonize and coordinate policies in these fields with a view to achieving ecologically rational, economically sound and socially acceptable development policies and programs for the Convention area.

    The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) - currently ratified by 187 countries - is the only human rights treaty that deals specifically with rural women (Art. 14). Adopted in 1979 by the United Nations Generally Assembly, entered into force in 1981. The Convention defines discrimination against women as follows:

    Poor women in developing countries rely on land as source of livelihood. Increasing pressure on land — brought on by globalisation pressures, increased population and privatisation — undermines women’s land tenure security. The comparison of women’s land access is predominantly measured against that of men, and this has been the basis for formulating policy aimed at increasing women’s land tenure security. However, this dichotomy reduces women to a homogenous group which experiences tenure security in an identical manner, so the dichotomy masks several differences which exist among women.

    WOLREC undertook this action research in order to enhance women’s bargaining power through improved access and control over land in the patrilineal and matrilineal communities in Southern and Northern Malawi. For WOLREC, as an action-orientated NGO, the exact nature of the relationship between women’s bargaining power in the household and their access to, and control over land is key to deciding which interventions improve poor rural women’s access to economic justice.

    An Act Relating to Arbitration.

    This Act makes provision for the resolution of disputes by arbitration. The authority of an arbitrator or umpire appointed by or by virtue of an arbitration agreement shall, unless a contrary intention is expressed in the agreement, be irrevocable except by leave of the Court. “Arbitration agreement” means a written agreement to submit present or future differences to arbitration.

    These Regulations, for purposes of section 4 of the Africans on Private Estates Act, prescribe forms for: the register of resident Africans; the document certifying registration; and the register of Africans entering an estate under special agreements. The Regulations also specify particulars that shall be included in the registers.

    The Act makes provision for the adjudication and registration of rights and interests in land in areas declared to be adjudication area by the Minister. Land shall be adjudicated by an Adjudication Officer appointed by the Minister. The Minister shall also appoint Demarcation Officers, Recording Officers and Survey Officers. The Act sets out the principles and procedure of adjudication.
