This Act is divided into 7 Chapters and 48 articles: State lands (Chap. I); Reserves (II); Private lands owned by the State (III); Rights and obligations regime on lands (IV); Transfer procedures (V); Registries of rights and obligations (VI); Final provisions (VII). This Act defines State lands as: (a) the lands of river beds and marine waters; (b) underwater shelves; (c) any kind of island; (d) land reserved for strategic purposes; (e) private and public road lands; (f) airports (art. 1).

This Act regulates the right of use of public and private lands of the Overseas territories. This Decree-Law, composed of 39 articles, rules on State’s withdrawal from the management of production units. To this end, it stipulates that the Government shall implement development programmes, as well as define the guidelines for the zoning of the production units to be assigned. The Decree-Law indicates the procedures for State withdrawal, the applicable concession regime, the forbidden property concessions, and the admitted applicants.

A independência de São Tomé e Príncipe, em 1975, foi um projeto de um grupo muito restrito de exilados. O arquipélago tornou-se independente sob a liderança do Movimento de Libertação de São Tomé e Príncipe (MLSTP) e Pinto da Costa. Apesar de alguns militantes viverem no Gabão e não serem socialistas, o MLSTP, apoiado pelo Movimento Popular de Libertação de Angola, tornou-se socialista. Depois de 1975, sob a ditadura do partido único, o MLSTP tentou impor uma política que enfatizava o valor do trabalho e o ideal do homem novo.
