    In this report, Physicians for Human Rights (PHR) outlines the findings of its recent survey of households forcibly displaced by the Thilawa Special Economic Zone development project in Burma. The Japanese government and three Japanese companies partnered with the Burmese government and a consortium of Burmese companies to develop the site, a project that will require the relocation of nearly 1,000 families in total. PHR’s findings cover phase one of the project, during which 68 households were displaced.

    Despite the tens of millions of dollars in aid and concessional loans being spent in Cambodia with the ostensible aim of securing land tenure and making the management of land and natural resources more equitable and sustainable, the evidence shows that tenure insecurity, forced evictions and large-scale land grabbing are escalating to alarming levels.

    OPENING PARAGRAPH OF EXECUTIVE SUMMARY: Whereas 2011 had seen a sharp increase in the number of Economic Land Concessions (ELCs) granted by the Royal Government of Cambodia to private companies, in 2012 conflicts became more acute and protests multiplied. The government showed that it had understood the seriousness of the situation by taking initiatives aimed at resolving land disputes, addressing some of the issues related to ELCs and granting thousands of land titles to rural families.

In Cambodia, there has been a surge in economic land concessions, in which long-term leases are provided to foreign and domestic investors for economic development. More than two million hectares have been leased so far, sparking debate over the consequences for local communities and the environment.

    ABSTRACT ORIGIN UNKNOWN: This report provides a recent update on land policies in the ethnic regions of Burma following the 2010 national elections and the beginning of the ceasefire with the Karen National Union in 2012. The authors argue that, while military conflict and associated abuses have declined, the Burmese government’s commitment to foreign investment and export-led economic growth is making traditional land tenure even less secure than before.

    Through LMAP, and subsequent LASSP, Cambodia has made impressive progress in building a functioning cadastral system over the last ten years. This process has proved complex and challenging, but since commencing, the land registration teams have successfully issued over 1.7 million land titles, a strong legal framework has been developed for the functioning of the land administration bodies and mechanism, institutions have been built and strengthened, and a dispute resolution process has been established for dealing with disputes over unregistered land.

    With a focus on the Lower Mekong countries, this study considers the intersecting issues of land access, livelihoods, management of risk and poverty for men and women smallholder farmers, the land poor and the landless, and how these issues might be addressed in policy and practice. While there has recently been insightful analysis concerning land access, livelihoods, and global land insecurity, we know much less regarding specific mechanisms that keep rural agricultural smallholders and the landless or land poor struggling and it is these issues that we address within this report

    ABSTRACTED FROM CHAPTER INTRODUCTION: The preceding chapters of this book give a central place to the Powers of Exclusion framework for understanding transformations in land relations, as developed in our 2011 book on Southeast Asia. A couple of the main aspects of the two books make for an interesting comparison. The first is that each employs a regional frame of reference to explore themes in changing land relations. The second is their respective development and application of a common conceptual framework.

    The series of studies of which this is the overview are a contribution to the third year of this process. The aim of the studies has been to pull together in a simple form, updated information about large-scale land acquisitions in the region, with the aim of identifying trends, common threats, divergences and possible solutions. As well as summarising trends in investment, trade, crop development and land tenure arrangements, the studies focus on the land and forest tenure and human rights challenges.
