The Botswana High Court recently issued a landmark ruling: four sisters are permitted to inherit their family home even though a customary rule prohibits women from inheriting property. The High Court ruled that the customary rule violated women’s equal rights. Remarkably, the High Court issued its decision in the face of strong government support of the customary rule. The details of this watershed case are featured in a recent article by City Press.

Writing at the Council on Foreign Relations’ “Africa in Transition” blog, John Campbell notes that South Africa’s land “issue” is not so simple. How true. Back in 1994 the ANC pledged to transfer ownership and control of 30% of white-owned farmlands to black South Africans by 2014. The process, based on a “willing buyer/willing seller” model has been halting at best and too often communities and farmers that did benefit from a redistribution of land lacked the background or capital to develop sustainable commercial entities.

Southern African Agriculture and Climate Change: A Comprehensive Analysis examines the food security threats facing eight of the countries that make up southern Africa — Botswana, Lesotho, Malawi, Mozambique, South Africa, Swaziland, Zambia, and Zimbabwe — and explores how climate change will increase the efforts needed to achieve sustainable food security throughout the region. Southern Africa’s population is expected to grow at least through mid-century. The region will also see income growth.

This paper analyses the shifting role of South African farmers, agribusiness and capital elsewhere in the Southern African region and the rest of the continent. It explores recent trends in this expansion, and investigates the interests and agendas shaping such deals, and the ideologies and discourses of legitimation employed in favour of them. While for the past two decades small numbers of South African farmers have moved to Mozambique, Zambia and several other countries, this trend seems to be undergoing both a quantitative and a qualitative shift.

A land transaction is generally not a recurring action for most buyers and sellers, their experience and knowledge are limited, for this reason the services of property agents and valuers are sometimes used, just to get more information available. The condition of insufficient information and the inability to observe differences in land productivity gives rise to the undervaluation of good land and overvaluation of poor land.

To redress past racial discrepancies in ownership and tenure, the ANC government of South Africa initiated programmes to make land accessible to the previously disadvantaged. A key component of the national land reform programme was the provision of commonage lands to urban municipalities for use by the urban poor. However, there has been no assessment of the contribution that urban commonage makes to previously disadvantaged households.

In the early 1980s residents of Hobeni, in South Africa’s Eastern Cape, were subjected to forced resettlement, under “betterment” policy ostensibly aimed at soil conservation. They were moved into a spatially contiguous but socially differentiated village. South Africa’s political transition ended this policy, and in the early 1990s, some people, mainly from part of the resettlement area (Kunene) characterized by dense kinship networks who had faced pressure to leave, and began to return voluntarily to their former sites, opting to live in dispersed, flexible settlements.
