Market-based land reform in Zambia
Rapports et recherchesdécembre, 2005ZambieThis paper explores the politics of ‘customary’ land tenure, land reform, and traditional leaders in Zambia. In Zambia, as elsewhere in Southern Africa, the government at the behest of donors has implemented market-based tenure reform legislation. This legislation aims to improve the security of land tenure and to promote development through investment. The paper shows how complex, indeterminate, and contentious this tenure reform has been on the ground – particularly in relation to the 94 per cent of Zambian land that is held in ‘customary’ tenure.

Government has been implementing the Land Resettlement Programme for over twenty four (24) years, focusing mainly on land resettlement for agricultural purposes without a comprehensive policy and legal framework. This has caused a number of challenges including lack of a coordination mechanism at higher level of Government in the implementation of the land resettlement programme, land disputes and low levels of infrastructure development and service provision in the resettlement schemes.

Rapid population growth combined with fast rate of land transfer and land conversion urges for an effective land administration and management in Bangladesh. But the land administration system in Bangladesh is corrupt, inefficient, and unreliable and inherently contains systematic weaknesses. It proliferates and perpetuates the endemic nature of land disputes. Nearly 80 percent of court cases in the rural areas are estimated to be related to land-conflicts.

The land administration system in Bangladesh is not well-developed. It is beset with multiple defects and problems. It is corrupt, inefficient, and unreliable and inherently contains systematic weaknesses. Corruption has become a grave issue in this sector. A World Bank survey reveals that most crimes and corruptions in Bangladesh take place in land-related services. It has estimated that more than 3.2 million land-related cases are pending before the judiciary. A large number of the aggrieved persons is not empowered enough to approach the courts for litigation.

There are competing claims to land, widespread conflicts, resultant landlessness and poverty. Other issues are limited availability of undisputed farmland, difficulties in accessing grazing lands and many disputes over pasture lands. These issues are exacerbated by conflicting land ownership systems, insecure land tenure and registration, weak land governance environment and uncertain and incomplete legal frameworks.

Nor has the extensive academic literature on Afghan history been translated into policy; on the contrary, much that has been attempted in Afghanistan since late 2001 has been remarkably ahistorical. This report identifies broad historical patterns and distills relevant lessons that may be applicable to policies during the 2011 to 2014 transition and beyond.

The report and associated policy brief focus on the cotton cluster system, a landmark privatisation initiative designed to improve agro-industrial productivity, and address the structural drivers of systematic forced labour in Uzbekistan. State-organised forced labour regimes in Uzbekistan’s cotton sector have attracted significant domestic and international criticism over the past decade.
