Clear, secure rights to manage and use forests are an important aspect of sustaining traditions and economic opportunities. Although this web site often discusses property rights in the context of developing countries, insecure title and undocumented land rights can undermine smallholder ownership in the United States as well.

Around the world competitive forces are driving a variety of investors to search for land for agriculture, for mineral exploration, for conservation, for biofuel production, etc. Investment in land is not per se bad. Development can bring important benefits to communities: new knowledge and skills, new connections to markets, in some cases employment, and perhaps other positive spillover benefits related to spending money in the local economy.

Due to implementation land use planning, controlling is needed as effort for the implementation is appropriate with the planning. According to Spatial Planning Act No.26/2007, land use control instruments are zoning regulation, permit, incentive and disincentive, and sanction. In Indonesia, zoning regulation is new instrument and only a few of city that have made and uses zoning regulation as land use control instrument.

A community’s choice to give, or withhold, their free, prior and informed consent (FPIC) to a project or activity planned to take place on their land is a recognized right of Indigenous peoples under international law. It is also a best practice principle that applies to all communities affected by projects or activities on the land, water and forests that they rely on.
