    The aim of this paper is to explain, with the aid of institutional economic theories, why Dutch works councils may contribute to an efficient governance structure. To this end, in this study a sketch will be given of the existing structure, in which the particular Dutch two-tier system plays an important role. After a short discussion of the property rights theory, transaction costs theory and the principal-agent theory, these theories will be applied to the Dutch corporate governance structure and more specifically to employee participation rights.

    Land retains a focal point in Kenya's history. It was the basis upon which the struggle for independence was waged. It has traditionally dictated the pulse of our nationhood. It continues to command a pivotal position in the country's social, economic, political and legal relations. It is not surprising therefore that land has since the colonial times to-date, been the subject of myriad state managed policy and legal interventions. Neither is it surprising that it has been the subject of many Commissions of Inquiry.

    This report sets out the results and key insights from recent research on land policy and analysis of specific interventions relating to land. The aim is to highlight the importance of nuanced policy advice, but also to illustrate some general principles for formulating such policy advice in specific country settings.Conclusions and recommendations include:providing secure tenure to land is needed to improve the welfare of the poor, in particular, by enhancing the asset base of those, such as women, whose land rights are often neglected.

    This paper looks at the role of market imperfections in explaining leasing behaviour of households using sample data from the Highlands of Eritrea. It looks at the tenancy or land rental market, the position of households in that market (as landlords, tenants or non-participants) and assesses the transaction costs related to the adjustment process in the tenancy market.The paper tests for fixed and variable transaction costs related to adjustment in the land rental market. A two-stage approach for participation in the market as landlords or tenants is used for this.

    An executive summary and recommendations are followed by 5 chapters: on the land question, reform and farm workers; the scope and process of fast track reform; the impact of land reform on farm workers’ livelihoods; food security, vulnerable groups, HIV-AIDS and coping strategies; and after the ‘promised land’ – towards the future. Study reveals that by early 2003, only about 100,000 of the original c.320,000 farm workers were still employed on the farms, the others are jobless and landless and have lost their entitlement to housing, basic social services and subsidised food.
