AFRA is an independent land rights non-governmental organization that works with black rural people in KwaZulu-Natal who were dispossessed and whose land tenure rights remain insecure. As such AFRA engages with the different programs within Land Reform, one of which is the Restitution Program. AFRA works primarily with three claimant groups, the Boschoek claimants, the Dukuduku claimants and the Gongolo claimants, each described briefly below.

This section will look at the issue from a pragmatic perspective of choice. This involves assessing what issues inform whether South Africa can chose either to replace or to ignore communal tenure by analysing what is likely to remain the same politically, socially and economically for the foreseeable future and what the forces are changing this situation. This assessment then allows us to assert some practical, general principles that inform the two projects with which this paper is concerned.

The annual meetings of this project concentrate on narrowly defined aspects of expropriation, and facilitate discussion amongst international academics and other experts on shared issues in Expropriation Law. The project gives delegates the opportunity to participate on the global platform, alongside leading scholars in the field of expropriation law.

Experience both here and elsewhere in Africa also tells us that attempts to change tenure tend to result in a “defaulting” back to what is known, often with increased confusion and conflict over procedures and adjudication authorities.

The restitution programme occupies a particular place in the broader land reform programme as it specifically seeks to redress the land dispossession which took place since 1913 and to alleviate the impoverishment and suffering it caused. Restitution is a hugely challenging undertaking which involves much more than the verification of claimants and the restoration of land.
